Preamble The site is the property of ALVEOLYS in its entirety, as well as all related rights. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, hypertext type links to the site are authorized without specific request.

1. Acceptance of conditions

The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relations between ALVEOLYS and its customer, with both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, unless otherwise waived, expressly and in writing.

2. Products

ALVEOLYS guarantees that the detailed description of the products presented is accurate. Photographs illustrating the products do not fall within the contractual scope. If errors are introduced, under no circumstances can ALVEOLYS be held liable. The majority of products offered to its customers by ALVEOLYS are available. In the event of a prolonged out of stock, the buyer will be notified by e-mail. A shipping delay or refund will be offered, at the buyer's option.

3. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. ALVEOLYS confirms acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded upon confirmation of the order. ALVEOLYS reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The information provided by the buyer, when taking the order, binds him: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which he may be able to deliver the product.

4. Delivery

After order confirmation, ALVEOLYS undertakes to deliver all the references ordered by the buyer within the following deadlines: Normal delivery in mainland France: between 3 and 4 days. These deadlines are understood upon receipt by the seller of payment, excluding weekends. All orders placed with ALVEOLYS are intended for the personal use of customers, the customers or recipients of the products prohibiting any partial or total resale of the products. Delivery in mainland France will be made by post via Colissimo with tracking. Any delays do not entitle the buyer to claim damages or reimbursement of shipping costs. The buyer can request the tracking number by email to contact@alveolys.fr. The following are considered as force majeure relieving the seller of his obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of being supplied. The goods always travel at the risk of the recipient. Always check your package upon arrival. You have 48 hours to make any reservations with the carrier in the event of something missing or damaged. In the absence of instructions from the buyer relating to shipping, the seller reserves the right to have the goods transported as best as possible, without incurring any liability as a result. In the event of it being impossible to deliver the ordered goods within the buyer's home due to inadequate means of access to said premises or due to their cramped conditions, the seller will not be able to do so. in no case be held responsible, unless expressly informed by e-mail when ordering. For reasons of availability, an order may be delivered in several installments to the customer. The customer only pays for one delivery. If the customer wants 2 delivery locations, he places 2 orders, with the associated delivery costs.

5. Price

The price is expressed in euros including tax. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France. This price includes the price of the products, the costs of handling, packaging and conservation of the products, transport and commissioning costs. Shipping costs are at least 6.50 euros. For a purchase over 65 euros including tax, my shipping costs are offered by APIMER.

6. Payment

The price invoiced to the customer is the price indicated on the order confirmation sent by ALVEOLYS. The price of the products is payable in cash and without discount on the day of the actual order. Payment is made by bank or postal check. The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. In the event of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, ALVEOLYS reserves the right to refuse any order from a customer with whom there is a dispute.

7. Disputes

This contract is subject to French law. ALVEOLYS cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from malfunction or misuse of the products sold. The same applies to any modifications to products resulting from manufacturers. The liability of ALVEOLYS will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution in particular with the help of: a professional association of the sector, a consumer association or any other advice of his choice. Please note that the search for an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee. Please note that as a general rule and subject to the judgment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee presupposes that the buyer honors its financial commitments to the seller. Complaints or disputes will always be reviewed with careful consideration, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer will contact APIMER as a priority to obtain an amicable solution. Failing this, the Commercial Court of SAINT-BRIEUC has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

8. Return order

According to article L121-20-3 of the Consumer Code, you have 14 days from receipt to return the product that does not suit you. To do this, please provide us with your order number when returning the goods. The merchandise must be returned complete (packaging, accessories, instructions, gift or promotional offer attached to the order). Shipping and return costs will then be your responsibility. Only the price of the product(s) purchased will be refunded. Items and their boxes returned open, incomplete, damaged, damaged or soiled by the customer are not taken back or a fee of €30 excluding tax may be charged in the event of a damaged box. These refunds will be made within a period of less than or equal to 15 days after receipt of the products by us. The reimbursement will be made at the choice of ALVEOLYS by credit to your bank account or by bank check addressed to the name of the customer who placed the order and to the billing address. No cash on delivery will be accepted, whatever the reason. 9. Warranty

In any event, the customer benefits from the legal guarantee of eviction and hidden defects (Art. 1625 et seq. of the Civil Code). Provided that the buyer proves the hidden defect, the seller must legally repair all the consequences (art. 1641 et seq. of the civil code); if the buyer goes to court, he must do so within a “short period of time” from the discovery of the hidden defect (art.1648 of the civil code). 10. Legal information

The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. Failure to provide information will result in the order not being validated. In accordance with the “Informatique et Libertés” law, the processing of personal information relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access and modification from ALVEOLYS. In addition, ALVEOLYS undertakes not to communicate, free of charge or in exchange for compensation, the contact details of its customers to a third party.
